I have never been asked to authorize a redistribution of my repaint.
This is a quote from the read me file that I in the zip file
“This is a freeware you may NOT redistribute this repaint to make money or without the author authorization.”
And it just came up at FSPlanet

Oh dear! BR_ this guy (Ferdi) is renown for this. You might want to talk to Tipster (John) as he is taking legal action against him, I think he has some site setup about this.

First, I'm already mental.
Secondly, I'm waiting on several people to come back to me at the moment. The issue with our notorious `friend` is far from over and although the big wheels turn slowly, they do eventually turn.
I remain steadfastly committed to bringing Ferdy to account for his arrogant disregard for both the law and the wishes of freeware authors. The clock is still ticking..

on which site did you upload it BR, fsfreeware?
fsplanet or whatever you guys call t is a BIG pain in the ass...
it went down the drain together with the IFSA...
abd BR_, try to downlaod the file and e-mail the author who repainted it that it isn't allowed (or did evil ferdy did it himself?)
and FSTipser... the guy has satelite internet AFAIK...
IP adress of the website is 216.40.197.204
if he would take the rules others made up as serious as he takes the ones he made up for himself, the site would be dead by now

it is not only the fact that he HAS a banlist, but also that our big 'uber-noisemaking' friend Mike Hambly is on it
it's the one of the few big names i can find on that list, together with Shigeru Tanaka...
and he WILL upload things repainted by the 'deLuca' guy...

Put some pressure on it, the previous thread already is down to page 8 of the FS2002 forum so no-one pays atention to it.
The only way to stop it at this moment is to get yourself on his banlist. The way how to do it is quoted in their 'privacy statement'
When i'm gonna make addons they are going to be released only when this pest is removed.

Ferdy has no influence on the first class thing, that's done by Mondadori.
And FSTipster tried this already (and some others) without ANY success.
The only thing you can consider now (and I admit it's a loss for the community) is to drop ALL support for that pirated addon, and let it be removed from the other (and your own) sites until FSTipsters legal action has any succes.

You forgot Dan's and my name on that list. We fought against him with out BH's and IL-76's. We have also gone into legal proceedings. I just think he's a scum bag and a disgrace to the flightsim community. I had this little (not really little lol) chat with Ferdy over MSN (forgot his MSN email because he blocked me). BUT I saved a transcript of the entire conversation. You get a real look into his mind on this. If anyone wants it please go here
http://www.tlukdesign.co.uk/erik/ferdyconv.htm
; As you can see on it he goes back a few times, and I hit him on alot of stuff, lol you gotta read the ENTIRE thing.

- he evades the discussion.
- he dumbly quotes a random freeware EULA
- he doesn't (want to) know that there are more forms of freeware than only the GNU license
- he says: 'a program is freeware when you have access to the source' but how can you have access to the source of an addon while the main program has NO access to it's source AT ALL, meaning that the maker of the addon has spend loads of time to get his FDE right by following the guessowrk of others
The only goal for Ferdy is to piss off any addon developer who does not adhere to the GNU freeware license... while the license agreement of his site DOESN'T PROVIDE ANY OF THE FREDOMS THE GNU LICENSE PROVIDES

oh how nice they are to each other...
that was to be expected...
first Jan visser left because of team troubles, now they seem to have split up alltogether... and didn't make any regulations about use of the communal materials.
still if someone managed to get that freeware version... pm me the license agreement
