A lot of times I hear people around the local airport talking about this law in Texas.  They say that it is legal to put a working gun on an airplane.  Is that true?

i believe there is nothing stopping licensed people taking them on light aircraft, if you want to say go hunting somewhere and you want to fly instead of drive and so on, i am not 100% sure on that but i do remember reading something along those lines.

Thats why I said working, people have "non working" guns on restored aircraft.  Like this, sort of, I saw a restored P-51 in a classified add and it said it was restored completely, all 6 .50s worked.  You could load a couple belts in and go "cow tipping" at the local ranchers farm.   Grin  Could you do something like that in Texas?  Just not shooting anybody's anything.

The best person to ask on this would be Oso as he is from Texas and knowledgeable about firearms.
I would imagine that on a private aircraft there are no restrictions, however on a commercial flight I'm sure its NOT permitted after certain events a couple of years ago Sad

I'm from Texas, and I'm pretty sure there is no law against taking firearms onto a light aircraft, but I'm not positive. I also can't see anything wrong with the P-51 thing as long as nobody or nothing is hurt.

Haven't you heard of the Second Amendment?

You can take a gun anywhere you want as long as there isn't a law saying you can't, like (federal) commercial (interstate) aircraft, military installations, courthouses, (state) bars (one of the few wise gun restrictions I've seen), courthouses, etc.

And gun laws are subject to the Second Amendment.

Florida's gun laws are about as unrestrictive as Texas, but you can't carry a concealed weapon without a permit.

I don't want to get off on a rant here ...

But the federal government royally screwed us when it forced passage of the 14th amendment.  The original US constitution was intended to grant and restrict powers of the federal government.  State governments were free to enact their own gun control and other laws, even laws "in violation" of the Bill of Rights - since the Bill of Rights and the entire federal constitution only applied to the federal government.

After passage of the 14th amendment state govermments found themselves bound by federal government restrictions.

If it weren't for the 14th amendment a liberal state like New York could totally ban guns and a conservative state like Alabama could totally ban abortions.

Of course this is just my opinion, I could be wrong.

Can't own a machine gun in the US without special permit. Or barrel is plugged with solder or de-activated in some manner. Some military stuff is excepted with special permit as well - gotta make movies ya know.

Some time I will tell you the story about the rubber tired tank we rented in Hollywood in the early 70s and the San Diego Freeway......

The difference is in the flight. Commercial or private. Doubt if many would hijack a plane that only has 3 or 4 people aboard.

Not being American, I can't very well comment on your laws or Constitution.
However it seems to me there are two discussions going on here and no-one has mentioned the difference.

There is 'carrying' or 'placing' a gun onto a private or commercial plane - and then there is "INSTALLING" a working (I believe full auto's are illegal even in th US) as part of an aircraft.

I can't see anything in stopping me, for instance, taking my handgun onto a private plane here in Australia where the laws are far more stringent, so long as I have the ownser permission. But I could never get it onto a commercial flight.

As for full Auto Machine guns on a 'Warbird' - the first, and only question, from authorities and the public would have to be - 'Why do you need them working, what is the 'necessary purpose' involved here??  ;D ;D ;)

I would imagine the necessary process for working guns on your warbird would be straffing your annoying neighbours house..... Maybe thats why I can't get a permit Grin Grin Grin
As for hijacking Oso, it'd depend on who those 3-4 people were...... Again my neighbours and certain relatives creep onto my list Grin Grin Grin

I imagine these days the autorities would be a bit averse to permitting working machine guns just so that movies could have their realism.
After all, they can insert all kinds of effects and graphics so that things look better than real. I can't see few muzzle flasshes and a bolt slamming back and forth being good enough reason for a movie production company to get a machine gun permit.

But then we are talking about the US and Hollywood...........lol Grin Grin Wink

Is it possible to transport weapons on a commercial flight?

I mean, say you're on holiday and you get a pistol of some sort, how do you legally get it transported onto the commercial flight? Couldn't it be surrendered to the authorities for safekeeping untill you reach your destination?

hey andrew, i belive you can transport working weapons on a commercial flight but they have to be inside a locked case and the key must remain with you at all times. the weapon also has to be declared to the local authoritys so they can check it isnt illeagal, from what i remember reading its best to always call in advance and arrive at the airport so all this can be dealt with quickly and no chance of missing a flight. and obviously said weapon must travel in the cargo hold.
i remember seeing an episode of airport where these students bought a rifle bolt as a gift and they had enough problems transporting that, then some guy managed to get this big ass shotgun checked in without any problems:)

that penguin thing is hilarious:)

I lived in Queensland for a short time, over 20 years ago. I had a licensed handgun then also. When I flew to Queensland and when I flew back to NSW, I had to have the weapon inspected by the Police (the state I was flying from) and they gave me a "permit to transport" which I had to then take to the airport and give to the Airline clerk, who had to get the Pilot of the flight (Captain) to counter sign.

I had to have the weapon packaged prior to going to the airport (so the clerk, pilot etc never saw the weapon - only sighted by the Police prior to my leaving) and escorted to the baggage compartment where the loading was supervised by me, an airline representative and a member of the cabin crew (I recal in one case it was a stewardess).
The only other alternatives to get it back to Sydney would have been to post it (yeah!) or pack it in the removal van (yeah!).

This all took place in the early '80's, so it may well be even tougher as our gun laws are mnore stringent than they were then. And they were pretty tight even then.

It's not that I would ever suggest special treatment for anyone, but many people seem to be getting enjoyment from it. I think I'll start a poll (I'm sure Pete didn't create the poll facility so we could use it against him by way of a petition.............lol Grin)

What is it with the rifle on a rack in the rear window, anyway.
We see it in alot of movies an TV shows.

Surely, they are only needed when you actually set out to go hunting.

It's a bit suss taking them down to K-mart to do the shopping, isn't it?

(Or is it that it's a way for people to have a firearm handy with the hassle of licensing a handgun?)

As a professional pilot, I recently had my nail clippers confiscated. To enter the SIDA(The Ramp) we now have to pass a security check, just like the rest of the general populace(just in case we have intentions of comandeering our own aircraft, I suppose!) I informed the TSA official that was OK, I would just use the the cockpit crash axe for my next manicure. "Only in America"..........you said it. Angry Angry Angry

What is the point. If the pilot wanted to, for instance, crash his plane into a building, (God bless all those souls), wouldn't he just ...........DO IT, with or without his 'nail clippers'.  Jebus. H

Like fitting a Browning machine gun, etc, to a restored  SE 5A bi-plane...?
Do these guns have to be blanked-off so that they cannot fire live rounds, (or even blanks)...?

That was what my first post was about. the issue seemed to be alternating between 'installing' guns on a plane and 'taking' guns onto a plane.

I think the original topic was about fitting guns to restored aircraft, but everyone just went into the gun law business.

Texans get excited about "Big guns" alright.

But they get even more excited about "Bigguns" Grin

Will provide an explanation of the difference in the two terms if needed for you Yankees upon request!  Wink

Ozzy - will post tank story for you tomorrow. It probably isn't that good now - but what we were smoking at the time made us laugh at just about anything.
