The real issue that everyon has with this site is that BOTH the Webmaster and more particularly his Host www.mondalori.com both freely advertise and SELL (for $) your hard work in creating freeware add-ons for the FS community on CDROM.
This is the core of the whole issue and WHY you should put disclaimers in your readme files.
Now Ferdy does NOT put this on his site anymore , BUT the host certainly DO. THEY are the ONES making money out of OUR hard work and GENEROSITY of making freeware files available from sites such as www.simviation.com etc.
Beery, this IS the breach of copyright. It is also theft to knowingly take a file (or anyother object etc), without the owners knowledge or permission.
You could therefore extrapolate that if you download from FSplanet you are most likely in the receipt of stolen goods; of which this is also a criminal offence in Australia (i have no idea as to other countries).

Beery, please don't think that one is berating you etc, far from it. I for one am certainly glad that you have expressed a quite good opinion.

yah i bet that is a big load of bogus, i highly doubt he is, and even if he was, i believe microsoft asks them to keep that sort of stuff on the D.L.

Watchdog won't do anyhing (except maybe mention it from "the desk") because no money is invovled.

You should be very careful with the advertisers though, because if he has good lawyers, its possible that you will (unjustly) go down for defraud.

At worst it would probably be called slander-not an informed legal opinion though.
My feeling is that alot of us have dogs and snailmail of dog-poop to their corp. offices might be a nice touch.
Just to let them know how much their actions stink.

FS2002tipster and everyone else,
This is the first time i've posted on these forums and i hope what i say is useful, i have been following this thread and the previous thread with some interest and can sympathise with those wronged.

A few people have already indicated that flight simulation is still enjoyed by a minority, so publicising this problem will not attract much attention from the media. Also some people have said (correctly or incorrectly) that because the addon's involved are freeware, then they do not hold enough weight for subsequent action. It seems like the only way Mr Serena will sit up and take notice is if a big group or company got involved. FS Planet has a film's page http://www.fsplanet.com/videos.htm

There seems to be a number of copyright infringements on this page, and i believe that the copyright holders will probably take action if they were aware of this site. There seems to be a lot of big companies involved, as there are a lot of film clips posted.

I'm not trying to be a sly opportunist, but i just couldn't believe no one has already thought of contacting the copyright owners for the films to get their support in this matter. It could be worth a try.

Is the website Mr Serena's primary form of income? I sincerely hope it isn't. What an awful way to make money.

I'm really amazed at how some business owners conduct business, how does one expect to prosper with
business ethics like this. I've owned my own business now for more than 6 years and I've found that one big thing is to have respect and a genuine concern for the field your in and the customers you service.
If this man has a web-site for this hobby wouldn't it go to reason that he would respect the artists of the community?  That site has been around for awhile and I'm trying to figure out how becuase I wouldn't last a year in business treating the people in my community that way.  Maybe some day he'll have a wake-up call.

For everyone who tried to get some of the banners from that page in the past...
He has replaced them and they are now:
- Simware, 3x
- fsfreeware.com (probably his new source of stuff-soon-to-be-prated)
- E-Dimensional

For more info on the guy himself...
In the past he had times when he couldn't update because he was abroad. His primary profession WAS Bus driver a few years ago. That was BEFORE the demise of that great FS FTP server (ftp.flight-sim.iup.edu) ant it's later mirror (IFSA) which was his previous (free) file provider.

Mondadori had mirrored a large part of the files of that server, so he went over to that server for his file providing needs. In the first months (year??) it was a free service... it sucked, but it was free. late they went over to a payed premium service and a limited free service (just as flightsim.com did)


 

Russian planes: IL-76 (all standard length ones),  Tu-154 and Il-62, Tu-134 and An-24RV&&&&AI flightplans and repaints can be found here
