hey
why is it when i try to download somt'n form FSPLANET its says dat downloads start from some place else and then it says that it cantt find service.
Also FsFreeware doesnt work for more then 5 days whats up with it!!

As far as FSPLANET goes, when the little window comes up when you try to d/l jusy follow the links in that window and it will take you to the FS files on their server, they are just trying to get you to buy a membership. On the FSFreeware deal, I can't find a way around every since they went with the pay membership, guess "WE" won't be going there any more!

FSPlanet & Sr Serena, the bozo who runs it, is the biggest pirate in the world of FS.  Angry Angry Angry

He has upset so many designers by his continuous abuse of copyright & abusive replies to designers when he is asked to remove files.

NO-ONE uploads there. He is well known in the design world as a pirate & I feel sorry for anyone who joins up.

I have several design friends who have showed me the letters he has sent. The level of venom has to be seen to be believed. One good friend, a well known designer, has all but given up the hobby as a result. 

FSPlanet is an insult to the aircraft designers world & the whole Flight Simulation hobby. I would implore everyone to boycott it!  Angry

Fsfreeware.com is another download site, with a good amount of detailed scenery. But, they charge for most of their files.

Don't know the origin of the files. I don't want to make any assumptions, but charging $14.00 for a chunk of scenery sounds like "supplimental income" for somebody. But, who knows for sure?

Well i agree whole hartedly the clown who runs it, is a pirate and i am one of the designers he has made more than slightly annoyed, on his site he posted my space shutttle package, that not in its self a crime. I dont mind re-distribution as long as it remains as it was when it came of my site but it wasn't it was modified by someone else and when i sent him an e-mail asking him to remove it i did not even get a reply i think we should boycot FSPlanet forever as we can get most if not all of the aircraft on his site from Simviation.com without the hassle of his site and its membership things (con)

TLUK has had problems with them already, they have uploaded our files to them before, after we asked them not to. Me, Dan and Alan had talk with Ferdy before, he also brought in the owner of FSFreeware. I don't know but I think those two are in league with each other, they both offer First Class Membership etc etc. Enough is enough. As im on a roll here  Wink i'll take the time to point out a few things. On his site is says  24,000 visits daily!, yea, i'll beleive it when hell freezes over. #1 Worldwide Flightsim Database over 23,000 files no Avsim, SimV, and Flightsim are, they have over 25,000 files im sure. Here is a copy of there privacy statement, I have outlined in bold where they have broken there own rules.

Yes you can.

However, this is not easy. I have been personally involved in internet litigation when a couple of pages from one of my websites were blatantly ripped off. It took me over a week of constant searching before I found a solicitor who knew anything about internet law as it relates to copyright, never mind one that would actually take the case on.

Because you're often persuing a matter internationally, it can get hideously expensive. I was fortunate. The offender was in the U.K. and a phone call to his I.S.P. (who are also legally liable in cases like this) resulted in his site disappearing.

Unfortunately, the practical difficulties of persuing legal recourse against a site in a foreign country deter most people. I have to say that a phone call to an i.s.p. as was recommended to me, is often far cheaper and more effective, as long as you can prove that the files were originally yours and subject to copyright.

FYI, my 2 cents worth.
I agree completely with your views on FSPlanet, as I too had some files taken from the 1 and only site I uploaded them to. They suddenly appeared at FSP without my knowledge. When I emailed and got no response, I posted my complaint on their forums.  Needless to say, I was deleted and blocked from their forums...LOL

FSFreeware...well..I go to that site almost everyday.  I've never paid once for access to the free files that are stored there.  While with the recent change, it is quite hard to access the free file area, they don't really have anything that you can't find here at Simviation.

What did I do?
I sent Mr Serena an email explaining that removal of my files was to happen ASAP and that his site does NOT display ANY of my newly posted files at any time.
In this letter, i explained that under Australian Law breach of Copyright is a Gaolable offence, which carries a maximum penalty of 2yrs &/or a $50,000 fine. As this law as i understandand it is a criminal offence he could face extradition to Australia for criminal procedings.
I also sent a copy of this letter to the Directors of http://www.madalori.com (who host's his files).
I also said (with all honesty) that i would complain vigorously to both the Spanish Emabassy & the Italian Embassy (the host servers for FSPlanet is Italian), that their respective actions are in material breach of copyright and by posting these files without the authors permission consists of software theft.

I eventually got a respopnse, a generic email stating that my work was to no longer appear @ FSplanet.
Round 1 to me.

This sort of thing happens often enough from individuals, but personally, I find it outrageous that a well known (if not popular) site has gotten away with this for so long.  Angry

Count me in, I have several files that have "appeared" on his site, all without my permission and in direct material breach of the copyright notice. The ONLY site I have ever uploaded to is Simviation.

This sort of behaviour threatens the very fabric on which the FS community is based, and it must be stamped out.

I think we should send the petition to the respective ISP, and INTERPOL, the Pan-European police force, which have an anti IT crime unit.

Also, I have started by sending him an email requesting my files be removed by 00:00 GMT on the 28th Feb. I'll let you know what his responce is, let's hope it's favourable.

Just my two penny's worth

PS, maybe Pete can put forward his thought on this, he must be fairly knowledgeable about the legal obligations of the ISP/Webmaster relationship?
